Terms of Service

1. Service overview

Apex Coastal Tech, LLC (“Apex”) provides scheduled vessel inspection and monitoring services in Northwest Florida. We document the condition of your vessel; we do not perform repair work.

2. Plans & billing

  • All plans are month-to-month with no long-term commitment.
  • Billing occurs on the first business day of each month via Stripe.
  • Plan upgrades are prorated and take effect immediately. Downgrades take effect at the next billing cycle.
  • Cancellation requires 30 days written notice (email is fine).

3. Access to your vessel

You authorize Apex stewards to board your vessel at agreed-upon intervals to perform the services in your plan. You are responsible for ensuring we have safe physical and slip-gate access. If we cannot access the vessel for a scheduled visit, the visit counts as completed for billing purposes (we will reach out to reschedule).

4. Insurance & liability

Apex Coastal Tech, LLC carries general liability insurance and a Marine Operators Legal Liability policy covering our stewards while aboard your vessel. Certificates available on request. Apex's liability for any single incident is limited to the lesser of (a) actual direct damages or (b) twelve (12) months of fees paid by you.

You remain responsible for maintaining your own hull, liability, and casualty insurance on the vessel. Apex is not an insurer.

5. Repair referrals

When we identify a repair need we may refer you to ABYC-certified mechanics in our network. Any contract for repair work is between you and the mechanic; Apex receives no referral fee and is not a party to the repair agreement.

6. Storms & emergencies

Post-storm checks (Commander and Admiral plans) are best-effort and depend on safe access to the marina. We will not put stewards in danger. If a named storm prevents us from reaching the vessel within 48 hours of marina re-opening, we will visit at the first safe opportunity.

7. Acceptable use

You will not (a) use the Owner Flight Deck to transmit unlawful content, (b) attempt to access other clients' data, or (c) reverse-engineer the platform. Either party may terminate for cause on a material breach not cured within 14 days of written notice.

8. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Escambia County, Florida.

9. Changes

We may update these terms. Material changes will be emailed to active clients at least 30 days before they take effect.
